3. Digital Products

Omega Marketplace is a platform for buying and selling digital products, including but not limited to themes, templates, plugins, scripts, graphics, and code. All products are delivered digitally and are available for immediate download after purchase.

4. Purchases and Payments

  • All payments are processed securely through Stripe
  • Prices are displayed in the currency configured by the platform
  • By completing a purchase, you agree to pay the listed price plus any applicable taxes
  • You will receive a license key and download access upon successful payment
  • Download limits and expiration periods may apply depending on the license type

5. License Types

Products may be offered under different license tiers:

  • Standard License: For personal projects and single end products
  • Extended License: For commercial projects and multiple end products
  • Unlimited License: For unrestricted use across all projects

The specific terms of each license are defined by the seller and displayed on the product page. Please review the license terms before purchasing.

6. Refund Policy

Due to the digital nature of our products, all sales are generally final. However, you may request a refund within 14 days of purchase if:

  • The product is significantly different from its description
  • The product contains critical errors that prevent its intended use
  • The product files are corrupted or incomplete

Refund requests are reviewed on a case-by-case basis. To request a refund, contact our support team through the contact form.

7. Seller Terms

If you register as a seller on Omega Marketplace:

  • You must complete the Stripe Connect onboarding process to receive payouts
  • You are responsible for the quality, accuracy, and legality of your products
  • You grant Omega Marketplace a non-exclusive license to display and distribute your products on the platform
  • Products must comply with our quality standards and will be reviewed before publication
  • Listing products on the platform is free of charge
  • A platform commission is applied to each sale, as disclosed during seller registration
  • Payouts are processed directly to your bank account via Stripe Connect
  • You are responsible for declaring and paying any applicable taxes on your earnings

8. Prohibited Content

You may not upload, sell, or distribute products that:

  • Infringe on intellectual property rights of third parties
  • Contain malicious code, malware, or security vulnerabilities
  • Include illegal, offensive, or harmful content
  • Violate any applicable laws or regulations
  • Misrepresent their functionality or purpose

We reserve the right to remove any product and suspend the associated seller account without notice.

9. Intellectual Property

  • Sellers retain ownership of their original content
  • Buyers receive a license to use purchased products according to the selected license type
  • The Omega Marketplace brand, logo, and platform design are our exclusive property
  • You may not reproduce, modify, or distribute our platform content without written permission

10. Limitation of Liability

Omega Marketplace is provided "as is" without warranties of any kind. We are not liable for:

  • Any indirect, incidental, or consequential damages
  • Loss of data, profits, or business opportunities
  • Issues arising from third-party products sold on the platform
  • Service interruptions or technical difficulties

Our total liability shall not exceed the amount you paid for the specific product or service in question.

11. Account Termination

We may suspend or terminate your account at any time if you:

  • Violate these Terms of Service
  • Engage in fraudulent or abusive behavior
  • Upload prohibited content
  • Attempt to circumvent platform security measures

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify users of significant changes via email or platform notification. Continued use of the platform after changes constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by and construed in accordance with the laws of Romania. Any disputes shall be resolved in the competent courts of Romania.
