Welcome to Omega Marketplace. By accessing or using our platform, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account, browsing, purchasing, or selling on Omega Marketplace, you agree to these Terms of Service, our Privacy Policy, and any additional guidelines posted on the platform. If you do not agree, please do not use our services.

2. Account Registration

To access certain features of the platform, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these terms.

3. Email We Send You

Having an account means receiving email about it: order confirmations, download links, license keys and password resets. These are part of the service and cannot be turned off while the account is open.

We may also send marketing email — our newsletter, and reminders about items left in your cart or wishlist. Every marketing email carries a one-click unsubscribe link that never expires, and one click stops all of it.

4. Digital Products

Omega Marketplace is a platform for buying and selling digital products, including but not limited to themes, templates, plugins, scripts, graphics, and code. All products are delivered digitally and are available for immediate download after purchase.

5. Purchases and Payments

• All payments are processed securely through Stripe
• Prices are displayed in the currency configured by the platform
• By completing a purchase, you agree to pay the listed price plus any applicable taxes
• You will receive a license key and download access upon successful payment
• Download limits and expiration periods may apply

6. Commercial License

Every product on Omega Marketplace is sold under one license, the Commercial License. It is defined by Omega Marketplace and applies to every product on the platform; sellers do not choose between licenses and they do not write their own license terms.

With the Commercial License you may:

• Use the product in unlimited projects, your own or your clients'
• Use it in paid end products, including SaaS, store apps and client sites
• Modify the source and use the modified version in your own work

You may not resell or redistribute the source, or a derivative of it, as a template, theme, starter kit or component library, whether for sale or for free, or use it to build a competing product sold as source code. Third-party components inside a product keep their own licences, and those licences travel with them.

Purchases made before 5 October 2026 keep the rights of the license named on their receipt as published at the time; Standard purchases now also benefit from the Commercial License.

7. Refund Policy

If you are a consumer in the European Union, you normally have fourteen days to withdraw from a purchase without giving a reason. Our products are downloaded immediately, so before you pay we ask you to confirm two things: that you want the download to start at once, and that you accept losing the right to withdraw once it does. You cannot complete a purchase without confirming, and we record the moment you did.

None of this affects your rights where a product is faulty, incomplete, or not what it was described to be. Those are covered below.

Due to the digital nature of our products, all sales are generally final. However, you may request a refund within 14 days of purchase if:

• The product is significantly different from its description
• The product contains critical errors that prevent its intended use
• The product files are corrupted or incomplete

Refund requests are reviewed on a case-by-case basis. To request a refund, contact our support team through the contact form.

8. Seller Terms

If you register as a seller on Omega Marketplace:

• You must complete the Stripe Connect onboarding process to receive payouts
• You are responsible for the quality, accuracy, and legality of your products
• You grant Omega Marketplace a non-exclusive license to display and distribute your products on the platform
• Products must comply with our quality standards and will be reviewed before publication
• Listing products on the platform is free of charge
• A platform commission is applied to each sale. Your current rate is shown on the Subscription page of your seller dashboard, and changes to it take effect only for future sales
• Payouts are processed directly to your bank account via Stripe Connect
• You are responsible for declaring and paying any applicable taxes on your earnings

9. Prohibited Content

You may not upload, sell, or distribute products that:

• Infringe on intellectual property rights of third parties
• Contain malicious code, malware, or security vulnerabilities
• Include illegal, offensive, or harmful content
• Violate any applicable laws or regulations
• Misrepresent their functionality or purpose

We reserve the right to remove any product and suspend the associated seller account without notice.

10. Intellectual Property

• Sellers retain ownership of their original content
• Buyers receive a license to use purchased products according to the selected license type
• The Omega Marketplace brand, logo, and platform design are our exclusive property
• You may not reproduce, modify, or distribute our platform content without written permission

11. Limitation of Liability

Omega Marketplace is provided "as is" without warranties of any kind. We are not liable for:

• Any indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• Issues arising from third-party products sold on the platform
• Service interruptions or technical difficulties

Our total liability shall not exceed the amount you paid for the specific product or service in question.

12. Account Termination

We may suspend or terminate your account at any time if you:

• Violate these Terms of Service
• Engage in fraudulent or abusive behavior
• Upload prohibited content
• Attempt to circumvent platform security measures

13. Changes to Terms

We may update these Terms of Service from time to time. We will notify users of significant changes via email or platform notification. Continued use of the platform after changes constitutes acceptance of the updated terms.

14. Governing Law

These terms are governed by and construed in accordance with the laws of Romania. Any disputes shall be resolved in the competent courts of Romania.
